Effective September 21, 2026. By creating an account or using The Artist Wall, you agree to these terms.
You must be at least 13 years old to use The Artist Wall. If you are under the age of majority where you live, you may use the platform only with the permission and supervision of a parent or legal guardian who agrees to these terms on your behalf. You must have legal capacity to enter into these terms or be represented by someone who does.
You may use The Artist Wall only in compliance with applicable law and these terms. You are responsible for activity under your account, for keeping your sign-in credentials secure, and for providing accurate account information. You may not misuse the service, interfere with its operation, attempt unauthorized access, impersonate another person or organization, or use the platform for unlawful, fraudulent, abusive, or infringing activity.
The Artist Wall platform, including its software, site design, branding, logos, visual elements, text created by the platform, databases, and other proprietary materials, is owned by or licensed to The Artist Wall and is protected by applicable intellectual-property laws. Except for the limited right to use the service under these terms, no ownership interest or license to The Artist Wall trademarks, software, designs, or other proprietary materials is granted to you.
You retain ownership of content you submit, including artist or venue names, biographies, images, links, messages, booking information, and other profile material. You are responsible for that content and must have all rights and permissions necessary to submit and display it.
You grant The Artist Wall a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, transmit, display, and distribute your submitted content solely as reasonably necessary to operate, improve, secure, market, and promote The Artist Wall and your presence on the platform. This license lasts while the content is available through your account and for a reasonable period afterward for backups, legal compliance, fraud prevention, and previously authorized platform materials. It does not transfer ownership of your content to The Artist Wall.
If you believe content on The Artist Wall infringes your copyright, send a written notice to legal@theartistwall.com identifying the copyrighted work, the material you believe is infringing, where that material appears on the platform, your contact information, and a statement describing the basis for your claim. The Artist Wall may remove or restrict access to challenged material while a complaint is reviewed and may request additional information before taking action.
If your content is removed or restricted because of a copyright complaint and you believe that action was mistaken, you may contact the same address with the relevant account and content details and an explanation of why you believe the material should be restored. This process is an operational copyright-complaint procedure and does not state that The Artist Wall has completed any separate statutory designated-agent registration.
Paid artist memberships provide access to the applicable Artist, Spotlight, or Headliner plan. A Founder number assigned within Founder #00001–#10000 is permanent historical recognition once the qualifying transaction has been completed and remains valid. A Founder number may be invalidated or removed only where reasonably necessary because of fraud, an invalid or reversed payment, an approved refund that rescinds the qualifying purchase, account impersonation, or a material violation of these terms affecting the validity of the Founder claim.
Ending or downgrading a premium plan does not by itself remove a valid Founder number. Premium Wall footprint, analytics, promotion tools, discovery priority, and other premium features remain tied to the applicable active subscription.
Artist memberships renew annually unless canceled or otherwise ended. Upgrades may result in an immediate difference or prorated charge for the remainder of the active term. Downgrades are generally scheduled for the end of the current paid term, with current premium benefits continuing until the effective date.
You may stop future renewal using the cancellation controls made available for your membership. Unless required by applicable law or expressly stated at checkout, fees already paid for the current term are generally not automatically refundable merely because you stop using the service or schedule a downgrade.
Nothing in these terms limits any refund, cancellation, withdrawal, cooling-off, or other consumer right that cannot legally be waived in your jurisdiction. Approved refunds, payment reversals, chargebacks, or fraud-related actions may affect paid entitlements and may affect the validity of a Founder claim as described above.
Payments, subscriptions, renewals, and certain refunds are processed through third-party payment providers, including Stripe. Payment information submitted during checkout is handled subject to the payment provider's own terms and privacy practices. The Artist Wall does not guarantee the availability or error-free operation of third-party payment services and may rely on payment-provider records when determining whether a transaction, renewal, refund, reversal, or chargeback has occurred.
You may request closure of your account and removal or unpublishing of your public profile, subject to any self-service controls made available by the platform and any verification needed to protect the account. Closing your account does not automatically entitle you to a refund for a current paid term.
A valid Founder number remains part of the historical Founder record even if you voluntarily close your account, unless the Founder claim itself is later invalidated for one of the reasons described in the Founder-recognition section. Public profile content may be removed or unpublished after closure, while records reasonably needed for legal compliance, billing, fraud prevention, dispute resolution, backups, and permanent Founder history may be retained.
The Artist Wall provides tools for discovery, messaging, and booking inquiries. Unless expressly stated otherwise, The Artist Wall is not a party to agreements made directly between artists, venues, fans, or other users. Users are responsible for evaluating counterparties, negotiating terms, documenting agreements, and complying with laws, contracts, insurance obligations, permits, safety requirements, taxes, and payment arrangements related to events.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless The Artist Wall and its owners, operators, affiliates, officers, employees, contractors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from your submitted content, your conduct on the platform, your violation of these terms, your infringement of another person's rights, or agreements and disputes between you and another user.
The Artist Wall does not guarantee audience growth, followers, profile views, promotion results, bookings, revenue, or any specific placement or level of exposure beyond the product features associated with an active plan.
The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law. The Artist Wall does not promise uninterrupted availability, error-free operation, permanent availability of any particular feature, or that third-party services will always remain available. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
To the extent permitted by applicable law, The Artist Wall is not responsible for delays, interruptions, or failures caused by circumstances outside its reasonable control, including internet or hosting outages, failures of third-party infrastructure or payment providers, cyberattacks, labor disruptions, natural disasters, severe weather, governmental actions, war, terrorism, civil unrest, public-health emergencies, or similar events.
To the fullest extent permitted by applicable law, The Artist Wall will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, lost data, or reputational harm arising from use of the platform, user-to-user dealings, or inability to access the service. Rights and remedies that cannot legally be excluded or limited remain unaffected.
The Artist Wall may limit, suspend, or terminate access where reasonably necessary to address fraud, abuse, security issues, unlawful activity, infringement claims, payment disputes, impersonation, or material violations of these terms. Where practical and appropriate, the platform may provide notice or an opportunity to correct a problem before termination.
When an account is terminated or closed, access to private account features may end and public profile content may be removed or unpublished. Certain records may be retained where reasonably necessary for legal compliance, fraud prevention, billing records, backups, dispute resolution, or permanent historical Founder-number records.
Use of The Artist Wall is also governed by our Privacy Policy, which explains how personal information is collected, used, stored, and shared. Privacy questions and data requests may be sent to privacy@theartistwall.com.
Features may evolve as the platform develops. Material pricing or renewal changes should be communicated before they apply to a future billing period where required by applicable law.
These terms may be updated as the platform, business model, or legal requirements change. The effective date at the top of this page will be updated when changes are made. For material changes, The Artist Wall may provide additional notice through the service or by email before the updated terms take effect where appropriate or legally required. Continued use of the platform after the effective date of updated terms constitutes acceptance to the extent permitted by law.
Except where applicable consumer-protection law requires otherwise, these terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any court proceeding that is not subject to a legally required alternative forum will be brought in a court of competent jurisdiction in Ohio. These terms do not currently require mandatory arbitration or waive the right to participate in a class action; any future change to dispute-resolution procedures would require an updated version of these terms and appropriate notice.
If any provision of these terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. These terms, together with the Privacy Policy and any additional terms presented for a specific paid product or transaction, constitute the agreement governing use of The Artist Wall.
You may not assign or transfer your rights or obligations under these terms without written permission from The Artist Wall. The Artist Wall may assign these terms as part of a merger, acquisition, reorganization, financing, sale of assets, or transfer of the platform or business, subject to applicable law.
Questions about these terms, copyright, or other legal matters may be sent to legal@theartistwall.com.
